Bay City Commission takes first look at potential trash collection changes - MLive.com

BAY CITY, MI - Updates may be on the way to Bay City’s waste removal ordinances.

The Bay City Commission reviewed a proposed amendment to the Code of Ordinances related to solid waste during its Monday, Jan. 6. meeting.

According to a summary presented to the Commission, the updates and revisions are proposed to more accurately reflect and conform to industry standards and how the city’s Sanitation Division currently conducts operations.

The proposed changes focus on areas such as the refuse bin responsibility, yard waste, services and fees, and curbside pickup.

An amendment is proposed about the responsibility of refuse when placed for collection. The proposed amendment states that the owner, occupant, or person in charge of the residence shall clean up and remove any scattered refuse resulting from the breakage of a refuse container.

The section also states that any container which is blocked by a vehicle owned or operated by the owner, occupant or person in charge of a residence is not eligible for call back service.

The yard waste portion of the ordinance has changes being proposed that would further define yard waste collection, which is not currently laid out in the current ordinance.

The proposed amendment states that yard waste must be bagged, tied in bundles or placed in 32-gallon or smaller containers. The proposed changes also state that loose yard waste, aside from specified brush piles, would no longer be accepted.

As for brush collection, brush pick up would occur on the East Side from the 1st to the 15th of the month, and on the West Side from the 16th to the last day of the month. The amendment states that brush would be collected without a fee during April and November.

Brush piles regulations are proposed to be set at no larger than an area of 4’ wide, 8’ long and 4’ high, if the changes are approved.

Another recommended change states that refuse containers would not be serviced if they are not spaced a minimum of 3 feet away from other containers, trees, vehicles, utility poles or other obstructions.

Proposed additions include the option for city residents obtain 2 bulk item stickers per year without a charge and that excessive overflow items outside of refuse bins will be charged an overflow fee.

The changes include the addition of Sec. 86-74 to emphasize that certain materials would not be collected curbside by the city. The list involves items such as:

- Materials from the construction, remodeling, repair or demolition of buildings.

- Dangerous or hazardous materials including, but not limited to, those which are radioactive, acidic, caustic or explosive, such as propane tanks, small batteries and CFL bulbs.

- Automotive bodies, parts, batteries, tires or service waste.

- White goods, which is defined as all types of large household appliances, such as stoves, refrigerators, air conditioners, washers, clothes dryers, hot water tanks and similar items.

The addition also states that it shall be unlawful for any person to place, permit, cause or assist in the placement of any refuse, trash, yard waste, rubbish or junk generated or accumulated outside of the city on city or private property for collection by the city.

Other proposed additions to the code related to curbside debris include a section prohibiting placing contractor’s debris of landscape contractors trimming for curbside collection and a section stating that the city shall not collect refuse materials from industrial establishments.

The Commission moved to receive the proposed amendments for the first reading and to refer them to the next meeting on Jan. 21 for a second reading, followed by a possible adoption.
